Karaya Travel LLC Terms & Conditions

Thank you for choosing Karaya Travel, LLC for your tour. This Agreement outlines your legal rights and obligations as a client when booking a tour through us. “We,” “us,” “our,” and “Karaya Travel” refer to Karaya Travel, LLC, while “you” or “your” refers to the client visiting our website or booking travel services through us.

1. Client Requirements and Health

Clients are advised to carefully read the details of the itinerary before booking a tour to understand the activity level and requirements. You must be in good health and capable of participating in adventurous activities.

You are responsible for providing all requested information in a timely and accurate manner, including completion of the client form prior to your tour. We cannot be held responsible for problems or additional costs resulting from inaccurate or incomplete information.

Participants must inform us of any pre-existing medical conditions or dietary restrictions at the time of booking.

2. Booking, Pricing, Payment, and Travel Arrangements

2.1 Pricing & Payment

Current pricing is available on our website or in your itinerary. Prices are per person and, unless noted, are based on double occupancy. Single and triple occupancy may be available and will be indicated in the itinerary.

Prices are subject to change depending on the time of year, type of tour, market conditions, demand, and availability. We reserve the right to adjust prices at any time.

A $350 deposit is required at booking and is applied toward your total tour cost. Full payment is due per the provided schedule, and payment plans are available.

We accept major U.S. credit/debit cards, including Apple Pay, in U.S. dollars.


The $350 deposit is included in the total tour cost and is non-refundable in all cases.


2.2 Occupancy & Rooms

Pricing is based on double occupancy. Single occupancy incurs an additional fee. Triple occupancy, where available, provides a reduced per-person rate.


2.3 Group Size

Tours have a minimum and maximum number of participants, specified on the itinerary. If the minimum group size is not met, Karaya Travel reserves the right to revise pricing, modify itineraries, or cancel the trip. Participants will be notified in writing before any such adjustment. If these numbers are not met, tours may be canceled or modified.


2.4 Travel Arrangements

Do not purchase airline tickets until Karaya Travel confirms the tour and participant numbers. Airfare is not included and must be arranged separately. Once full capacity is reached, we will notify you to proceed with booking flights. Airlines are responsible for schedule changes, delays, cancellations, and other circumstances beyond our control.

3. Cancellation and Refund Policy

To cancel a confirmed booking, you must notify us in writing via email at support@karayatravel.com. Your cancellation will take effect on the date we receive your written notice. A cancellation fee, calculated as a percentage of the total tour cost, will apply based on the date your notice is received.

These charges apply to most tours; however, certain travel partners or service providers may have different cancellation terms that could result in higher fees. We will inform you of any such conditions at the time of booking.


Cancellation charges are as follows:

90 days or more before departure: You will receive a refund of all payments minus the $350 non-refundable deposit

45–89 days before departure: 50% of the total tour cost is non-refundable

30–44 days before departure: 75% of the total tour cost is non-refundable

29 days or less before departure: Non-refundable

The $350 deposit is included in the total tour cost and is non-refundable in all cases.

Refunds (if applicable) will be issued to the original form of payment within 30 days of receiving your written cancellation notice.

Please note: Some travel partners or accommodations may have separate cancellation policies that require additional fees. Any such conditions will be communicated at the time of booking.


3.1 No-Show Refund

No refund will be made for any unused travel services or any portion thereof, nor is the price or value of unused travel services exchangeable for alternative services.


3.2 Early Return

If you end your trip earlier than planned, whether voluntarily or due to unforeseen circumstances, no refunds will be issued for unused portions of your travel arrangements. We are not liable for any related expenses incurred during your early return. Travel insurance may provide coverage for curtailment; contact your insurance provider directly to file claims.


3.3 Cancellation for Insufficient Bookings

If insufficient interest leads to a tour's cancellation, any amount paid to Karaya Travel will be reimbursed minus a 3% service charge, provided the cancellation is made in writing by us or the tour operator. We are not liable for claims, losses, or damages resulting from cancellations beyond our control.

Clients affected by a Karaya Travel cancellation will be offered:

A transfer to a future departure date of equal value with the same destination, free of charge, or 

A full refund within 14 days, minus a 3% service charge.

4. Assumed Risk, Outdoor Activities, and Accessibility

All activities are undertaken at your own risk. You must behave responsibly and follow Karaya Travel and partner guidelines. We are not responsible for accidents caused by you or factors beyond human control. Certain excursions may require signing an additional liability release.

We may refuse participation to clients unable to complete the tour due to physical condition, injury, illness, or abusive behavior. No refunds will be provided for unused portions of the tour in such cases.


4.1 Accessibility and Medical Conditions

While we do not specialize in disability-focused tours, we will reasonably accommodate needs to ensure your comfort. Notify us before booking if a medical condition, disability, or special requirement may affect participation. You must also notify us of changes after booking. We may request a doctor’s certificate confirming fitness to travel. If needs cannot be reasonably accommodated, bookings may be canceled with applicable charges.

5. Travel Insurance

We strongly recommend purchasing travel insurance that covers cancellation, medical emergencies, and other risks.

6. Client Behavior

We may terminate arrangements if your conduct causes distress, danger, damage, or delays. You may be required to leave accommodations or services immediately. Karaya Travel is not liable for costs, losses, or expenses incurred as a result.

7. Alcohol and Drugs

Participation may be denied if under the influence of alcohol or drugs, or if behavior endangers others. No refunds will be provided, and full cancellation fees apply.

8. Force Majeure

Karaya Travel shall not be liable for any failure or delay in performing its obligations, or those of its partners, service providers, or representatives caused by circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, strikes, labor disputes, government actions, pandemics, or other force majeure events.


8.1 Consequences

Obligations are suspended during the event. We will make reasonable efforts to mitigate its impact and resume operations as soon as practicable. “Reasonable efforts” do not include incurring unreasonable costs, risks, or logistical burdens. We reserve the right to modify itineraries, substitute accommodations, or adjust services as reasonably necessary to address a force majeure event.


8.2 Notice

If a force majeure event affects our services, we will promptly notify you by email.


8.3 No Liability

Karaya Travel, including its employees, tour directors, guides, and other representatives, is not liable for damages, losses, or expenses arising from a force majeure event. In the event of cancellation due to a force majeure, any decision to issue refunds, credits, or rebooking options will be made at Karaya Travel’s sole discretion.


8.4 Right to Terminate

If a force majeure event continues and significantly affects our services, we reserve the right to terminate these terms without liability, upon written notice.


8.5 Continued Validity

Your obligation to pay for services provided prior to a force majeure event remains unless otherwise agreed in writing.


8.6 Insurance Responsibility:

Travelers are responsible for obtaining travel insurance that may cover losses arising from a force majeure event, including trip interruption, cancellation, or delay.

9. Changes by Karaya Travel

We reserve the right to modify or cancel arrangements due to unforeseen conditions. While we will make reasonable efforts to notify you promptly, we are not liable for obligations related to such changes. Such changes do not entitle clients to compensation, refund, or damages when they result from circumstances beyond Karaya Travel’s reasonable control.


9.1 Itinerary Changes

Weather, safety concerns, or other uncontrollable factors may require itinerary modifications. We will make reasonable efforts to provide alternative activities or accommodations.

10. Complaints

Any complaints must be reported to the tour operator or company representative immediately for prompt resolution. Complaints must also be submitted in writing to support@karayatravel.com within 14 days of the tour’s conclusion. Failure to do so may affect our ability to investigate and resolve the issue.

11. Liability Waivers

11.1 Third-Party Waiver Acknowledgement

Certain activities may involve third-party companies with their own waivers. You may be required to sign these before participation.


11.2 Responsibility

You are responsible for complying with any third-party waivers or agreements. Participation in third-party activities is voluntary and entirely at the participant’s own risk. Karaya Travel is not liable for interactions with third-party companies. 


11.3 Indemnification

You agree to indemnify and hold Karaya Travel harmless from claims, damages, or expenses arising from interactions with third-party companies.

12. Links to Third-Party Sites

Links are for informational purposes only. Karaya Travel has no control over third-party content and is not responsible for any loss or damage from their use.

13. Passport and Non-U.S. Citizens

Non-U.S. citizens are responsible for obtaining all necessary visas, entry documents, and health requirements. Failure to have proper documentation may result in denied boarding or entry without refund. U.S. citizens do not require a passport to travel to Puerto Rico.

14. Limitation of Liability

To the fullest extent permitted by law, Karaya Travel, LLC, including its employees, tour directors, guides, contractors, and representatives, shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages, including without limitation loss of enjoyment, emotional distress, lost profits, or loss of opportunity, arising out of or in connection with your participation in a tour, whether based on contract, tort, or otherwise. Karaya Travel’s total aggregate liability for any claim arising under this Agreement shall not exceed the total amount paid by you for the tour in question.

15. Governing Law and Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of the State of Colorado, without regard to conflict of law principles.

Any disputes arising out of or relating to this Agreement shall be subject to the exclusive jurisdiction of the state and federal courts located in Larimer County, Colorado.
