Karaya Travel LLC Terms & Conditions
Thank you for choosing Karaya Travel, LLC for your tour. This Agreement outlines your legal rights and obligations as a client when booking a tour through us. "We," "us," "our," and "Karaya Travel" refer to Karaya Travel, LLC, while "you" refers to the client visiting our website or booking travel services through us.
1. Client Requirements:
Clients are advised to carefully read the details of the itinerary before booking a tour to understand the activity level and requirements. You must be in good health and capable of participating in adventurous activities. It is imperative that you provide us with any requested information in a timely manner. This includes the client form that you will be asked to complete prior to your adventure. It is important that you complete all information we request accurately and on time as we cannot be held responsible for any problems or additional costs that may arise from any inaccurate or incomplete information that you may provide.
Participants must inform us of any pre-existing medical conditions or dietary restrictions at the time of booking.
2. Booking and Payment:
Prices are per person, based on two people sharing a room.
The most current pricing is available on our website.
Please note that prices may change depending on the time of year.
We reserve the right to change prices at any time, based on demand, market conditions, and availability.
To secure a reservation, full payment is required at the time of booking.
Major U.S. credit cards, debit cards, and PayPal are accepted,
Payment must be made in U.S. dollars.
3. Cancellations and Refunds:
To cancel a confirmed booking, you must notify us via email (hello@karayatravel.com). Your cancellation will take effect on the date we receive it. A cancellation fee, calculated as a percentage of the tour cost, will be charged from the date we receive written notification of cancellation. These charges apply to most tours. However, some suppliers have different cancellation conditions that may require higher fees. We'll inform you of any such conditions at the time of booking. Here's how cancellation charges are determined:
Cancellations made 90 days or more before the departure date are eligible for a refund minus the non-refundable deposit of $350.
45-89 days before the departure date - 50% of tour cost
30-44 days before the departure date- 75% of tour cost
29-0 days before the departure date - 100% of tour cost
The terms of the insurance policy you may have purchased may allow you to recover cancellation fees (minus any relevant excess) based on the reason for the cancellation. It is essential to file all claims directly with the insurance provider you have chosen.
3.1. No-Show Refund:
No refund will be made for any unused travel services or any portion thereof, nor is the price or value of unused travel services exchangeable for alternative services.
3.2. Force to return Home:
If you are forced to return home early, we cannot refund the cost of any travel arrangements you have not used. In cases where you shorten your vacation and return home prematurely we regret that we cannot provide a refund for the unused portion of your vacation. Additionally, we are not liable for any related expenses incurred during your early return. In certain situations, your travel insurance might provide coverage for curtailment. We recommend that you contact your insurance provider directly to file any claims related to curtailment.
3.3. Cancellation for Insufficient Bookings:
If insufficient interest leads to a tour's cancellation, any amount paid to Karaya Travel will be entirely reimbursed, provided we and/or the tour operator (not an individual traveler) cancels the tour in writing. We will not be held liable for any claims, demands, losses, or damages resulting from tour cancellations beyond our control.
In the rare occurrence of Karaya Travel canceling a tour, our clients will be offered the following options:
A transfer to a future departure date of equal value with the same destination, free of charge.
A complete refund paid within 14 days.
4. Force Majeure:
Karaya Travel shall not be liable for any failure or delay in performing its obligations under these terms and conditions if such failure or delay is caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, strikes, labor disputes, government actions, pandemics, or any other event of force majeure.
4.1. Consequences of Force Majeure:
In the event of force majeure, our obligations under these terms and conditions shall be suspended for the duration of the force majeure event. We will make reasonable efforts to mitigate the impact of the force majeure event and resume normal operations as soon as practicable.
4.2. Notice of Force Majeure:
If a force majeure event occurs that affects our ability to fulfill our obligations under these terms and conditions, we will promptly notify you of the event and its expected impact on our services.
4.3. No Liability for Force Majeure:
Our company shall not be liable for any damages, losses, or expenses arising from or related to a force majeure event, including but not limited to any inconvenience, disruption, or cancellation of services caused by such event.
4.4. Right to Terminate:
If a force majeure event continues for an extended period and significantly affects our ability to provide services, we reserve the right to terminate these terms and conditions without liability, upon written notice to you.
4.5. Continued Validity:
The occurrence of a force majeure event shall not excuse your obligation to make payments for services provided prior to the occurrence of the event, unless otherwise agreed upon in writing.
5. Changes by Karaya Travel
In some instances, due to our extensive planning process, we reserve the right to make modifications or cancellations to your arrangements. Although we will make every effort to inform you as soon as possible before your departure, we will not be held liable for any further obligations related to the aforementioned changes or cancellations.
5.1. Itinerary Changes:
Due to unforeseen conditions, such as weather, safety concerns, or other factors out of our control, Karaya Travel reserves the right to modify the itinerary. In such circumstances, reasonable efforts will be made to provide alternative activities or accommodations to ensure passenger satisfaction and create a more enjoyable travel experience.
6. Assumed Risk & Outdoor Activities:
Clients are advised that all activities are undertaken entirely at their own risk and they must behave in a fit and proper manner at all times in accordance with Karaya Travel and/or its partners’ guidelines and must take proper responsibility for their own safety. All adventure tours and outdoor activities carry inherent risk and Karaya Travel does not assume any responsibility for accidents that are caused by you or can be traced to their own actions or are caused by factors outside of human control (Force majeure). With the purchase of your tour you agree to these conditions, understand its implications and accept responsibility for your participation in your tour. Depending on the excursion, you may be requested to sign an additional liability release.
We reserve the right to refuse participation to any client who they believe will not be able to complete the tour because of their physical condition, injury, or illness. We reserve the right to refuse participation to participants that are being physically or verbally abusive, or if they pose a threat to staff members or fellow travelers in any other way. We regret that we cannot provide a refund for the unused portion of your vacation.
7. Health, Disabilities and Medical Conditions:
While we do not specialize in disabled tours, we are fully committed to accommodating any specific needs you may have to ensure your utmost comfort and satisfaction. If you have any medical condition or disability which may affect your active participation in your tour or the tour arrangements of any other person or have any special requirements as a result of any medical condition or disability (including any which affect the booking process), please tell us before you confirm your booking so that we can assist you in considering the suitability of the proposed tour and/or making the booking. In any event, you must give us full details at the time of booking and also update us if/when any change in your condition or disability occurs.
You must also promptly advise us if any medical condition or disability which may affect your active participation in your tour or the tour arrangements of any other person develops after your booking has been confirmed. We may require you to produce a doctor’s certificate certifying that you are fit to participate in your chosen tour. Acting reasonably, if we are unable to properly accommodate the needs of the person(s) concerned, we will not confirm your booking or if you did not give us full details at the time of booking, we will cancel it and impose applicable cancellation charges when we become aware of these details.
8. Travel Insurance:
As with any and all world travel, we strongly recommend that you purchase a travel insurance policy that covers your cost should you have to cancel your travel reservation with short notice. This kind of travel insurance is not expensive and frequently covers other risks.
9. Client behavior:
If we determine that your conduct is causing or has the potential to cause distress, danger, damage, or annoyance to others or their property, or if it may cause a delay or diversion in transportation, we reserve the right to terminate your arrangements without delay. Upon such termination, our obligations to you will end, and you will be required to leave your accommodation or other service right away. We will have no further obligations to you and will not cover any expenses, costs, or losses incurred as a result. Prior to departing from the tour, you may also be required to pay the third party supplier directly for any loss or damage resulting from your actions. If you fail to do so, you will be responsible for handling any subsequent claims or expenses made against us as a result.
10. Alcohol and Drugs:
In the interest of passenger safety and the overall enjoyment of our tours, we reserve the right to decline participation to any client who appears to be under the influence of alcohol or drugs. In such cases, there will be no refunds provided. Furthermore, our tour operators have the authority to deny participation to clients whose behavior or demeanor may cause offense, distress, or endanger other clients. In these instances, full cancellation fees will be applicable.
11. Group Size:
Tours have a minimum and maximum number of participants required. If these numbers are not met, we reserve the right to cancel or modify the tour. To ensure your tour takes place, we require a minimum of 8 and a maximum of 12 clients. Before booking your local or international flights, please confirm and coordinate with us regarding the number of participants. Additionally, please note that the purchase of airfare is not included in the tour package and must be arranged separately.
11.1. Rooms:
Tour quotes are based on double occupancy, but single occupancy can be requested at the time of booking for an additional fee, subject to availability.
12. General conditions of air transport:
We will promptly notify you upon reaching full capacity for the tour, enabling you to proceed with purchasing your airline tickets. The airlines determine the conditions of implementation of air transport and are solely responsible for the changes in schedules or routes, stops, changes of airport delays and flight cancellations. In most cases, all these circumstances respond to the overbooking of airspace, the need to respect the rules of air navigation and the period of maintenance of aircraft at airports, all with the sole purpose of ensuring safety for passengers.
We will not be liable for any schedule changes, delays, cancellations and other circumstances attributable to the carrier, your own actions or those of a third party or force majeure.
13. Complaints:
Any complaints or issues must be reported to the tour operator or company representative immediately to allow for prompt resolution.
14. Liability Waivers:
14.1. Third-Party Liability Waiver Acknowledgement:
By engaging in our services, you acknowledge and agree that certain aspects of our offerings may involve interactions with third-party companies. These third-party entities may have their own terms, conditions, and liability waivers that you may be required to sign before participating in related activities or services.
14.2. Responsibility of Third-Party Waivers:
It is your responsibility to carefully review and comply with any waivers or agreements presented by third-party companies. Our company does not assume liability for any interactions or engagements with third-party entities, including but not limited to activities, services, or events facilitated by them.
14.3. Indemnification:
By utilizing our services, you agree to indemnify and hold harmless Karaya Travel from any claims, damages, liabilities, costs, or expenses arising from your interactions with third-party companies, including any failure to adhere to their terms, conditions, or waivers.
15. Links to Third-Party Sites:
Karaya Travel links to other websites and resources provided by third parties, these links are provided for informational purposes only. Karaya Travel has no control over the content of those sites or resources, and therefore cannot be held responsible for any loss or damages that may arise from their use.
16. Passport and Non-U.S. Citizens:
Non-U.S. citizens are responsible for obtaining all visas, entry documents, health requirements and any documents required by laws, regulations, orders and/or requirements of the United States. All non-U.S. citizens traveling to Puerto Rico with Karaya Travel must have a valid and updated passport and must consult with appropriate consulates to determine if any visas are needed. No refunds will be made if improper documentation results in denied boarding or entry. U.S. citizens don’t need a passport to travel to Puerto Rico.
17. Special Request:
You must inform us by email of any special requests pertaining to your arrangements. We will make every effort to fulfill your reasonable special requests, but we cannot guarantee that they will be met. Although we may note special requests on your confirmation or other documentation, this does not constitute a promise to meet them. Unless a special request has been explicitly confirmed, our failure to meet it will not be considered a breach of these terms and conditions.
18. Photo/Video Waiver:
I understand and consent that KarayaTravel may record and/or include pictures, videos, and/or comments of the traveler in any future marketing materials including but not limited to the company’s official website. I understand that my name will never be included on KarayaTravel marketing and/or business materials without my permission.
19. Inclusions & Exclusions
When considering our tours at Karaya Travel, it is important to be aware of what is and is not included in the price. The cost of the tour covers transportation, accommodations, activities, and meals, as detailed on the tour itinerary page. However, any items not listed as included are the financial responsibility of the client. This includes international flights, visa and passport fees, vaccinations, travel insurance, optional activities, and other personal expenses.
20. Optional Excursions and Activities:
Regarding optional activities and excursions that might be available during your tour, we may provide information about them before departure or while you are on tour. However, these are not included in your pre-booked tour arrangements and are offered independently by local operators or providers who are not affiliated with us. They may or may not have their own public liability insurance.
If a tour operator helps you book or collect payment for any of these activities or excursions, we, along with the tour operator, act solely as booking agents for the local operator or provider. Their terms and conditions will apply.
We assume no liability whatsoever related to these optional activities or excursions. We do not guarantee their availability during your tour or that they will operate as advertised, as they are not part of karaya Travel and are beyond our control. They may not be available for various reasons. Any prices mentioned in advance are approximate. We are not responsible if you cannot book an activity or excursion or if it does not operate as advertised for any reason.
21. Limited Liability for Third-Party Travel Services:
While we strive to ensure the quality and reliability of the travel services we arrange, we expressly disclaim any liability for the acts, errors, omissions, or negligence of third-party companies providing travel services. Our company acts solely as an intermediary and does not assume responsibility for the performance, safety, or quality of these services.
21.1. Limitation of Liability:
In no event shall Karaya Travel be liable for any direct, indirect, incidental, special, or consequential damages arising from or in connection with your use of third-party travel services arranged through us. This includes, but is not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses.
22. Severability:
If any provision of these terms and conditions is unenforceable or invalid under applicable law, the invalidity or unenforceability of that provision shall not affect the validity or enforceability of the remaining provisions of the agreement. In such a case, the unenforceable provision shall be replaced with a valid and enforceable provision that achieves, to the extent possible, the original objectives and intent of the original provision.
23. Governing Law:
These terms and conditions, as well as any disputes stemming from or connected to your utilization of our services, will be subject to the laws of Colorado, United States of America, independent of any conflict of law considerations.
24. Changes to Terms and Conditions:
Karaya Travel reserves the right to update or modify these terms and conditions at any time, with changes becoming effective upon posting on the company's website. By booking a tour with Karaya Travel participants acknowledge that they have read, understood, and agreed to these terms and conditions.
